1. Overview & acceptance
By creating an account, accessing, or using NIX86 (the “Service”), you (“Customer,” “Venue,” or “User”) agree to be bound by these Terms of Service. If you register on behalf of a bar, restaurant, taproom, or other business entity, you represent that you have the authority to bind that entity to these terms.
2. The service
NIX86 is a cloud-based operations platform for independent hospitality venues. It includes employee scheduling, inventory counts, product mix entry, recipe and menu costing, staff messaging, event management, reporting, and vendor order generation. We grant you a non-exclusive, non-transferable, revocable license to use the platform for your venue’s internal business operations.
3. Free trial, subscriptions & billing
- 45-day free trial. New accounts receive full access to every feature for 45 calendar days. No credit card is required to begin.
- Paid plans. After the trial, continued access requires an active subscription: $74.99 per month billed monthly, or $64.99 per month billed annually.
- Automatic renewal. Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
- Cancellations & refunds. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current paid period. We do not provide refunds or prorated credits for partial periods or unused time.
- Price changes. We may change subscription pricing with at least 30 days’ notice before the change applies to your next renewal.
4. Vendor ordering & communications
NIX86 provides tools to compile, format, and transmit order requests to the distributors and sales representatives you designate, by email, text message, and one-click confirmation links.
- NIX86 is not a distributor, broker, or party to any purchase order or contract between your venue and your vendors.
- You are solely responsible for verifying cutoff times, minimum order thresholds, product availability, unit pricing, and delivery accuracy.
- We are not liable for delayed, rejected, unfulfilled, duplicated, or mispriced orders, or for messages that a vendor does not receive or does not act upon.
5. Scheduling, labor & compliance
NIX86 provides tools to schedule staff, estimate labor cost, and manage shift trade and time-off requests. You are solely responsible for ensuring that schedules, hours, breaks, minor work restrictions, overtime, and tip handling comply with all applicable federal, state, and local laws. Labor figures shown in NIX86 are planning estimates and do not constitute legal, tax, payroll, or accounting advice.
6. Your data & our platform
- Your data. You retain ownership of all data you enter, including recipes, inventory records, vendor lists, staff rosters, and operational history.
- Our platform. NIX86 retains all rights in the software, interface design, branding, and documentation.
- Privacy. Our handling of your data is described in the Privacy Policy.
7. Accounts, permissions & acceptable use
You are responsible for keeping your login credentials confidential and for the permission levels you grant your team (owner, manager, staff, bookkeeper access links). Notify us promptly of any unauthorized access. You agree not to misuse the Service, including attempting to access other venues’ data, reverse engineering the platform, or using it to send unlawful or unsolicited messages.
8. Third-party services
NIX86 relies on third-party providers for hosting, email delivery, payment processing, sports and weather data, and similar functions. Their availability is outside our control, and their own terms apply to the services they provide.
9. Suspension & termination
We may suspend or terminate access for non-payment, misuse, or violation of these terms. You may close your account at any time. On termination, your access ends and your data is handled as described in the Privacy Policy.
10. Warranty disclaimer & limitation of liability
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, NIX86 is not liable for indirect, incidental, punitive, or consequential damages, including lost profits, inventory loss, or business interruption. Our total aggregate liability will not exceed the amount you paid to NIX86 in the twelve months preceding the claim.
11. Changes to these terms
We may update these terms from time to time. Material changes will be announced in the app or by email. Continued use after the effective date means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
